Equipment Hire Terms and Conditions

 

Payment

Unless you have an account with us, full payment is due prior to hire or on delivery.

 

Responsibility

All responsibility remains with the hirer for the caring of hire equipment when delivered until pick up as there is no insurance on any equipment. If theft occurs while the items are in your care and control you have an obligation for replacement, either through cash settlement or a claim on your own insurance.

 

Breakages/Shortages

Our staff carefully check and pack all orders. If you notice any items missing or damaged when you receive your order, please notify us immediately. When your order is returned all shortages or damages must be paid for.

 

Bond

A cash or credit card security deposit is required with your order and prior to delivery. Bonds by cheque or credit to your credit card will be refunded within 10 working days after the date of return. Bonds will not be refunded by the driver. Cash deposits may be collected at the office or otherwise be refunded to you by cheque, credit card or eftpos.

 

Cartage and Labour fees

Where goods are to be delivered or picked up by the company a cartage fee will apply according to the
distance and degree of difficulty involved.

 

Cleaning

All equipment must be clean on return or a cleaning fee will be charged on any item returned dirty.

 

Cancellation

In the event of cancellation by the hirer more than 1 week prior to the event the booking fee is non refundable but may be transferred to cover another date. Less than 1 week but more than 48 hours - 25% of the total hire. Cancellation within 48 hours of event incurs total charges.

 

Weekend Work

When an event is to take place on a weekend, our normal procedure is to deliver Thursday and/or Friday and pick up Monday and/or Tuesday. However, if we elect to deliver or pick up on a Saturday or Sunday, we may do so at our expense. If you require the delivery and/or pickup on a Saturday or Sunday, an extra labour fee will be charged.

 

Public Holidays

When an event is to take place on a public holiday, our normal procedure is to deliver 1-2 days prior to the event and pick up 1-2 days after the event. However, if we elect to deliver or pick up on a Public holiday, we may do so at our expense. If you require the delivery and/or pickup on a Public holiday, an extra labour fee will be charged.

 

Fees

Additional charges include:

  • Delivery,
  • Damage Waiver and
  • GST.

 

Prices

We have the right to alter our prices without any notice. Reduced charges may be offered for a long term hire.

Severability of Terms

In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.

 

Entire Agreement

This Agreement shall be governed by and construed in accordance with the substantive laws of Australia, without any reference to conflict-of-laws principles. The Agreement describes and encompasses the entire agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the contents and materials provided by or through the Site, and the subject matter of this Agreement.

 

Governing Law

Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of New South Wales Australia, to the exclusion of any other courts without giving effect to its conflict of laws provisions or your actual state or country of residence.
